1. Agreement and eligibility
These terms form an agreement between you and GYMXP LTD when you use this website or join the waitlist. If you do not agree, do not submit the form.
You must be at least 16. If you are under 18, you confirm that a parent or guardian has given permission. You must provide accurate information and use an email address you are entitled to use.
2. What joining means
- Joining the waitlist and taking part in any invited pre-release testing are free. A future public product may include paid plans, but testing does not create a purchase obligation.
- We may send waitlist, testing, research and launch communications where you have consented.
- Position, invitation timing and access may depend on capacity, testing needs, location, device or other reasonable criteria.
- We may change, pause or close the waitlist and may decline or withdraw an invitation.
- “Founding access”, “founding athlete” or similar wording is a product-community description only. It does not create equity, ownership, employment, partnership, lifetime access, permanent pricing or a right to future benefits.
3. A product in active development
Product screens show the current product or current direction at the time displayed. Interfaces, names, scoring, programmes, rules, features, availability, prices and release plans may change.
References to future coach, client, sharing or platform functionality describe possible direction, not current functionality or a binding commitment. Any test build may contain faults and must not be relied on for medical, safety-critical or professional decisions.
4. Permitted use
We give you a limited, personal, revocable, non-exclusive right to view the website and evaluate any material we expressly share with you. You must not:
- copy, republish, mirror, sell, licence or commercially exploit GYMXP material without written permission;
- scrape, harvest, probe, disrupt, bypass security or use automated means to extract content or data;
- reverse engineer or attempt to derive source code, non-public scoring, models, rules, taxonomies, workflows, prescriptions, data structures or engine logic except where law expressly prevents that restriction;
- use GYMXP material to develop, train, benchmark or improve a competing product or model;
- impersonate GYMXP, register confusing names or domains, or suggest endorsement or affiliation without permission.
5. GYMXP intellectual property
GYMXP LTD and its licensors retain all rights in the GYMXP name and identity, logos, characters, product names, website, visual design, interfaces, software, code, databases, documentation and original content.
This also includes, where protectable, GYMXP scoring and prescription systems, decision-engine architecture, models, rules, taxonomies, workflows, plan logic, training-state methods, explanations and confidential know-how. Rights may arise through copyright, database rights, design rights, trade marks, patents, confidentiality and contract.
6. Ideas and feedback
You keep ownership of your original feedback. By voluntarily submitting product suggestions, test observations or feature ideas, you grant GYMXP LTD a worldwide, perpetual, irrevocable, royalty-free, transferable and sublicensable licence to use, adapt, combine, publish and commercialise that feedback without compensation or attribution.
This licence does not transfer ownership of your personal information, which remains governed by the Privacy Notice. Do not send confidential information or material belonging to somebody else.
7. Privacy and data handling
Personal information submitted through the website, waitlist, optional founder profile or communications is handled under the Privacy Notice. It explains what we collect, why we use it, the lawful bases we rely on, the service providers involved, international transfers, retention, security and your data-protection rights.
Agreement to these terms does not give GYMXP ownership of your personal information. Permission to receive waitlist and launch emails is requested separately, can be withdrawn at any time and is honoured through the unsubscribe process. Before the public product begins collecting account, training or health-related information, we will publish additional app-specific privacy information.
8. Fitness and training information
Website content is general product information, not medical advice, diagnosis or a promise of results. Training carries risk. Use appropriate technique, equipment, safeties and professional supervision; stop if you experience pain, dizziness or other concerning symptoms.
Consult an appropriately qualified professional before changing training where you have an injury, medical condition, are pregnant or are unsure what is safe for you.
9. Availability and liability
The website and waitlist are provided on an “as available” basis. We do not promise uninterrupted access, error-free content or that proposed functionality will launch. Third-party services have their own terms and availability.
Nothing in these terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud, or your mandatory consumer rights. Subject to that, GYMXP LTD is not responsible for indirect or consequential loss, lost opportunity, lost data or reliance on pre-release material.
10. Suspension and termination
We may restrict access, remove a submission or cancel a waitlist entry where reasonably necessary to protect users, GYMXP, our systems or legal rights, or where these terms are breached. Provisions concerning intellectual property, feedback, privacy, liability and governing law continue where their nature requires it.
11. Law, changes and contact
These terms are governed by the laws of England and Wales. If you are a consumer, you retain any mandatory protections and may be entitled to bring proceedings in your home jurisdiction.
